Five years after the removal from office of President of Kosovo and only a month before the election of the new President of Kosovo state, the former president, Behgjet Pacolli, has submitted to the Constitutional Court a request for the election of the president by direct vote of citizens .
The head of the New Kosovo Alliance (AKR) asks the Constitutional Court to interpret the resolution of Parliament, which was approved in 2011 following the political agreement between the head of the PDK, Hashim Thaci, one of the LDK, Isa Mustafa, as well as its head of AKR, Behgjet Pacolli, which stipulated that the choice of the next president of Kosovo to become citizens, and not by Parliament.
Top Channel has been provided by sources close to the Constitutional Court, the case that Pacolli has filed Thursday in court, according to which Pacolli has asked the Constitutional Court to certify violations of freedoms and rights of the complainant, and to compel the Assembly to implement Resolution, applying further voting procedure of constitutional amendments proposed for the direct election of the president, without prejudging the outcome of the voting and respect the mandate freely deputies of other constitutional principles.
Former President Pacolli claims that a violation of the Constitution is made continuously since 2011, when – according to his case, Parliament has been forced by the resolution, to cast a vote constitutional amendments, which predicted the election of the president by citizens.
In his request to the Constitutional Court, Pacolli has quoted the resolution adopted by Parliament on April 7, 2011, which stipulated that the first presidential elections in Kosovo were held not later than 6 months from the date on which the necessary constitutional changes and legislation will enter into force.
But, according to Pacolli, while the Assembly has formed a committee, which drafted the constitutional amendments for direct election of the President, the process is interrupted and the amendments that had passed the filter of the Constitutional Court were not thrown at all to vote in the Assembly.
Therefore, Pacolli claims that he and his party have been violated rights, as part of the agreement, which was transformed in the resolution. In this case, Pacolli has asked the Constitutional Court to certify violations of human rights and freedoms and to compel the Assembly to implement the resolution, applying the procedure further voting on the amendments proposed for the direct election of the president.
